OVERVIEW
These Terms regulate the access to or use of resources contained in the Shortstay Platform for all Users, anywhere in the world.
These Terms constitute a binding contract between you, as a User, and Shortstay, and govern your access to and use of all services related to the resources made available by Shortstay.
By using Shortstay Services with respect to any Product, you are responsible for identifying, understanding, and complying with all applicable laws, rules, and regulations. This may include, among others, rules of a civil nature, rules regarding intellectual property, privacy, and the use of personal data.
The language of these Terms is Brazilian Portuguese. Any version of these Terms in another language is a courtesy translation. In case of any conflict, the Portuguese version shall prevail for all agreements.
By accessing, browsing, or interacting with Shortstay, you declare that: (i) you acknowledge that you have read, understood, and agree to these terms of use, (ii) you are of legal age to enter into a binding contract with Shortstay, and (iii) you have the authority to accept these terms personally or on behalf of the entity you represent. If you do not agree to be bound by these terms, you may not access or use Shortstay.
To make use of Shortstay's services, the user must necessarily use the Shortstay application, which is available on Google Play and the Apple Store.
1. ACCEPTANCE OF TERMS OF USE
1.1. By creating an account on Shortstay, you agree to be bound by these Terms of Use, our Privacy Policy—each incorporated into this Agreement by reference—as well as any terms disclosed and agreed to by you when acquiring additional features, products, or services that we offer on the Service (collectively, the "Agreement").
1.2. If you do not agree to be bound by the terms of this Agreement, do not use the Service.
1.3. We may change this Agreement and the Services periodically for various reasons, whether to update them in relation to legal changes or requirements, new features, or changes in business practices. After you accept these Terms, Shortstay automatically grants you a non-exclusive license to use the Application. The features contained within the Shortstay Application are licensed as is. They may be modified, replaced, or removed at any time, without prior notice.
1.4. The most recent version of these Terms of Use is the one that applies.
1.5. If the amendments include significant changes that affect your rights or obligations, you will be notified in advance via the Shortstay Application.
1.6. If you continue to use the Services after the amendments come into effect, this means that you agree to the revised Agreement.
1.7. To use the Shortstay Application, users must accept the terms and conditions set forth herein and the Brazilian legislation governing the subject, as well as accept the terms and conditions described in the Shortstay Regulations, undertaking to comply with them under penalty of applicable civil and criminal measures. Users acknowledge that this document will be updated whenever necessary and will be available for consultation through a direct link on the platform.
2. REGISTRATION
2.1. To use the application, it will be necessary to provide personal data. The Shortstay privacy policy (https://shortstay.com.br/politica-de-privacidade) explains how users’ personal data will be used, processed, and protected.
2.2. To register in the application, the user must provide information regarding name, email, and telephone number, as well as create a personal and non-transferable password. The user is responsible for the accuracy of the information.
2.3. The user acknowledges that they should not share application access information with third parties, as doing so may constitute a breach of these terms.
2.3. The user agrees that they are solely responsible to us for all activities identified with their account and agree to promptly notify Shortstay of any unauthorized use of their username or password or any other security breach.
2.4. Users who may create fake accounts/profiles and/or by any other means improperly use the name, trademark, logo, and other copyrights and intellectual property of Shortstay, or any brand, will be deregistered and removed from the platform.
2.5. The user who violates any provisions of these terms of use or any Shortstay regulations may have their profile/account deleted, cancelled, and/or deregistered without any prior notification procedure and without being entitled to any type of compensation.
2.6. The user and respective account/profile that create and/or use false, fraudulent, and/or misleading claims intended to deceive other users and/or third parties, including those who employ such schemes and artifices to circumvent the rules and benefits offered by the application for their own benefit and/or that of third parties, shall also be subject to deregistration, cancellation, and/or deletion, without prejudice to the criminal liability of the offending user and possible losses and damages.
2.7. Shortstay will not tolerate any act by users that promotes violence, discrimination, or intolerance on the basis of gender, sexual orientation, race, sex, religion, nationality, socioeconomic status or similar matters, or any other conduct expressly prohibited by law.
3. PROVISION OF SERVICES
3.1. Shortstay will: (a) provide the Services to you in accordance with this Agreement; (b) comply with the security terms of the Services, as set forth in the Shortstay Security Overview; (c) provide the Services in accordance with the laws applicable to the provision of the Services by Shortstay to its clients in general (that is, without considering your specific use of the Services), subject to your use of the Services in accordance with this Agreement;
3.2. Shortstay provides a service defined as the intermediation of seasonal lease contracts for flexible periods (starting from 30 days), connecting property owners and users, including payments, contracting, document verification, and all services related to this type of lease. Authorized users may access and use the Service worldwide, subject to Shortstay's contract with the clients and Applicable Laws.
3.3. Two categories of users will be registered: the user who will use Shortstay's service as a tenant, that is, will use a property through Shortstay; and the owner user, who owns the property to be made available to other users.
3.4. All regulations regarding contract signing, various requests related to the contract, payments, and other requests shall be exclusively processed through the application.
4. USERS’ OBLIGATIONS WITH SHORTSTAY
4.1. All contracts generated by the system are verified regarding the information declared by the user. If a user provides false or incorrect information, he shall be fully liable under Brazilian law.
4.2. In the event of insertion of false information, the user may be held liable for the crime of ideological falsehood (Art. 299, Penal Code), as well as for damages caused (Art. 186, Civil Code).
4.3. Users must comply with the rules established at the time of contracting, as these are binding for the performance of the provided service.
4.4. Users must immediately notify Shortstay of any obstacle to the proper execution of the contracted service;
4.5. Shortstay will use all available evidence, including location data, electronic records, and audit logs, to support the enforcement of these laws in case of disputes or misuse.
5. PAYMENT METHODS, RESERVATIONS, RENTAL, SECURITY DEPOSIT AND FEES
5.1. A non-refundable entry fee will be charged, related to the contracting process, for the preparation and analysis of the documentation. The initial fee varies according to the standard of the contracted property.
5.2. A security deposit will be charged, the value of which varies according to the property and documentation presented. It will be credited in the lease agreement and refunded at the end of the stay after deductions for the exit cleaning and other final consumption amounts, inspections, and other applicable charges.
5.3. Payment for the stay must always be made in advance and through the following payment methods: Boleto, Pix, and Credit Card.
5.4. The keys to the contracted property will only be delivered after the lease agreement is signed and the first installment of the stay is paid.
5.5. There may be fees for services such as water, gas or electricity, which are not included in the condominium fee.
5.6. Shortstay offers services for the user's convenience, such as bed linen, towels, and blankets. Such services will be charged separately, and must be requested at the time of the contracting.
5.7. All contracting, management, and requests regarding the contracted property must be carried out through the Shortstay application.
5.8. In case of cancellation or no-show, the reservation deposit will not be refunded. There will be no reimbursement of rent or deposit if the guest decides to leave the apartment before the end of the term. Changes to reservation dates will only be permitted upon confirmation from Shortstay and may be subject to additional charges.
5.9. Upon confirmation of payment, a notice will be sent authorizing you to access the apartment. The key collection procedure will be defined according to the chosen building.
5.10. An entry inspection will be carried out, which will be duly forwarded to the user via email. Any observations may be submitted within 48 hours, bearing in mind that it is the user's responsibility to preserve the property throughout the entire stay.
5.11. Contract renewal is possible, provided that the deadlines established in the contract are observed. To this end, the user must request the renewal through the application, which will be charged separately, in accordance with the existing functionality.
5.12. The owner is guaranteed the management of the property, including management of the entire rental process, payment of all property-related invoices, entry and exit inspections, cleanings, and maintenance. All services are provided by Shortstay.
5.13. Invoices will be available to the user and will be encrypted for their security. To access them, the user must enter the password, which will be the first 5 digits of the user's CPF or CNPJ.
5.14. Interest of 1% per month and a fine of 10% will be charged on invoices paid late.
5.15. Users will receive their invoices via email and through the application. The payment and invoice history will always be accessible through the application. Invoices that have been settled will be marked as "Paid." Pending invoices will be marked as "Ready to pay" and overdue invoices will be shown as "Overdue."
5.16. Each renewal request for a reservation will incur a processing fee, which will be added to the next invoice.
6. RESERVATION POLICY
6.1. To make a reservation for the property, the user must provide the following information: full name, personal email, telephone number, nationality, RG or passport number, CPF or CNPJ, profession. The user is fully responsible for the accuracy of the information provided.
6.2. To complete the reservation, users must submit the requested documents through the application. Among others, documents verifying identity and proof of income will be requested. A selfie of the user will also be required.
6.3. Requests for reservation extensions are not guaranteed.
6.4. If there are additional guests, the full name, personal email, RG or passport number, CPF, and telephone number of each guest must be provided.
6.5. Shortstay may at any time request additional identification documents and a selfie for each guest through the application to verify their identity.
6.6. All personal data and information collected will be securely stored in Shortstay's systems and may not be accessed by any unauthorized individuals. Shortstay ensures that your personal information is protected in accordance with the General Data Protection Law (LGPD), maintaining the confidentiality and security of all data.
6.7. If, during the reservation review, any of the documents (identification document, Proof of Income, or Selfie) submitted by the user is incorrect, incomplete, or insufficient, Shortstay will notify the user through the application and request resubmission of the specific document that requires correction. The user must upload the document via the Shortstay application.
6.8. If the user does not upload the correct documents within the required timeframe, the reservation will be declined.
6.9. Shortstay will not accept documents sent through other platforms such as WhatsApp, email, or social networks, to ensure the security and authenticity of the process.
7. ON THE USE OF THE PROPERTY
7.1. Check-in is available from 14:00 onwards. Property access information and electronic door lock codes will be available through the Shortstay application from 12:00 on the guest's check-in date. In the case of physical keys, they will be delivered by Shortstay to the guest from 12:00 on the check-in day.
7.2. Should the guest encounter any issues, they must contact the Shortstay team via the application’s chat feature.
7.3. The guest hereby expressly authorizes the sending of the entry authorization document, which will contain the names of the guests and the start date of the stay.
7.4. Guests may access the Wi-Fi password through the application. Should guests experience connection issues, they must request assistance via the Shortstay application’s chat feature.
7.5. Guests are prohibited from resetting the modem within the property without prior authorization.
7.6. Each property has a maximum guest limit, which will be specified during the reservation process.
7.7. It is mandatory to declare any additional guests in the "Add guest" section of the reservation form.
7.8. If the user withholds information and does not comply with the informed number of guests, Shortstay may terminate the contract, reclaim the property, and apply a penalty to the user for contractual violation.
8. PET POLICY
8.1. Shortstay is a pet-friendly company, but owners or condominium residents have the right to decide whether to allow pets.
8.2. Pets are prohibited in properties that do not allow them. If the presence of a pet is discovered, the contract may be terminated, and the user shall be subject to a fine and other penalties.
8.3. In properties that allow pets, it is mandatory to notify Shortstay about the presence of a pet.
8.4. A one-time fee will be charged per pet.
8.5. During the move-out inspection, additional services may be charged for any damages to the property caused by the pet, such as cleaning of sofa, beds, curtains, tears in sofas, mattresses, among others to be identified and recorded during the inspection.
9. MAINTENANCE AND CLEANING SERVICES POLICY
9.1. Maintenance and cleaning requests must be made through the application.
9.2. All photos, videos, and texts sent will be stored in Shortstay's systems.
9.3. If the user is present in the property during maintenance or cleaning services, the team may enter using body cameras for the safety and transparency of all services.
9.4. Only Shortstay will have access to the body camera footage. The recordings will be stored for 30 days in Shortstay's systems and will be permanently deleted after this period.
9.5. The use of body cameras will be indicated when the user requests maintenance or cleaning through the application.
9.6. Body cameras are for the safety of users and employees.
9.7. The cameras will only be activated when the service providers are at the entrance door of the property.
10. PRIVACY AND DATA SECURITY
10.1. The Shortstay application is secure, and only Shortstay employees may access your information when necessary.
10.2. Shortstay does not share your personal information with third-party companies. However, to provide access to the property, we are legally required to share your name, check-in and check-out dates with the Building Managers, Condominium Administrators or Remote Concierges of the properties, in order to ensure your safety.
10.3. Information may also be shared with competent public authorities for accounting purposes and tax obligations in order to lawfully perform its activities.
10.4. Your information will also be used for Shortstay marketing purposes. By registering and logging in to short-term applications, the user declares that he or she has accepted this use.
10.5. To sign a document via the Shortstay application, the user must grant permission for location access, which is necessary to validate the signature.
10.6. Electronic signatures are legally recognized and enforceable under Brazilian legislation, especially under Provisional Measure 2.200-2/2001 and Law 14.063/2020, which regulate the use of digital signatures, granting them the same legal effect as physical signatures.
10.7. All activities related to the signing process, including user actions and contract generation, are securely saved in Shortstay’s and the service provider’s databases. This ensures that a complete record of the signing process is maintained in accordance with Brazilian data protection laws (General Data Protection Law - LGPD, Law No. 13.709/2018).
10.8. After signing the contract, the user may access a detailed audit report, which will be attached to the final page of the contract. This report will include timestamped information regarding each stage of the signing process, providing full transparency.
10.9. The use of secure and legally compliant systems ensures that all user actions are properly documented and enforceable in accordance with Brazilian law. This provides full protection for the user and the company in case of disputes or legal challenges.
11. TERMS
11.1. The use of Shortstay by the User shall be for an indefinite period and may be cancelled, fully or partially, at any time in the event of a violation of Shortstay’s terms of use.
11.2. Similarly, Shortstay may cancel any available feature at any time, undertaking to use its best efforts to notify Users of the scheduled cancellation periods.
11.3. In case of breach of this agreement and the conditions stipulated therein by the User, it shall be considered automatically terminated, and only those clauses and conditions which by their nature are intended to survive its termination shall remain in effect.
12. USER RESPONSIBILITIES
12.1. The user assumes full responsibility for the property rented and its belongings, as well as for any item belonging to the condominium. The same applies to other residents and visitors.
12.2. The client, all occupants of the property, and visitors must comply with the condominium regulations and its rules. Fines imposed by the condominium administration for noncompliance with the rules will be immediately paid by the client.
12.3. In the event of a violation of these terms of use or condominium regulations, the rental agreement may be terminated early without any reimbursement.
12.4. Any and all accidents occurring during the stay are not the responsibility of Shortstay.
12.5. We recommend utmost care and supervision with children and the elderly.
12.6. There are condominiums that do not allow visitor entry. Please contact us before making any reservation where visitors are expected, so that we can provide a more suitable property.
13. COPYRIGHT
13.1. All texts, images, drawings, graphics, sound, video, application structures, design, process, operations and/or technologies, explicit or implicit, such as drawings, sketches, drafts, manuscripts, photos, manuals, technical specifications or any other documents involving technology property rights and any other applications, are the property of this manager and are protected by applicable national or international law.
13.2. If any user believes that material hosted by SHORTSTAY infringes their copyright, this person may send us a written notification at privacidade@shortstay.com.br, with the necessary information, and we will attempt to remove or disable the allegedly infringing material.
13.3. Only the owner or their legal representative may submit the request mentioned in the above item.
14. GENERAL CLAUSE
14.1. Any failure by Shortstay to enforce any provision of these Terms shall not be considered a waiver of such provision nor of the right to enforce such provision. If any part of these Terms is found to be invalid or unenforceable under applicable law, including but not limited to the warranty disclaimers and limitations of liability set forth above, the invalid or unenforceable provision shall be deemed replaced by a valid and enforceable provision that most closely reflects the intent of the original provision and the remainder of these Terms shall remain in effect.
14.2. Any waiver or failure to enforce any provision of the Terms on one occasion shall not be considered a waiver of any other provision or of such provision on any other occasion.
14.3. These Terms constitute the final, complete, and exclusive agreement between the parties with respect to the subject matter hereof and supersede and merge all prior discussions between the parties regarding such subject matter.
15. JURISDICTION
15.1 - For the resolution of disputes arising from this instrument, the Court of Curitiba, State of Paraná, shall have jurisdiction.
