These Terms and Conditions of Use govern access, registration, navigation, use of the platform, application, customer service channels, services, functionalities, reservations, contracts, and any interaction conducted with Shortstay.
By accessing, navigating, creating an account, requesting customer service, submitting documents, making a reservation, signing a contract, making a payment, using a property intermediated by Shortstay, or continuing to use any Shortstay service, the User declares, freely, expressly, and unequivocally, that they have read, understood, and fully accepted these Terms and Conditions of Use, the Privacy Policy, reservation rules, property rules, condominium regulations, applicable contracts, and all other documents related to the contract.
If the User does not agree with these Terms, they should not create an account, access the platform, use the application, request customer service, make a reservation, contract services, or remain in a property intermediated by Shortstay.
These Terms constitute a binding contract between the User and Shortstay. The official language of these Terms is Brazilian Portuguese. Any version in another language will be provided for convenience only, with the Brazilian Portuguese version always prevailing in case of conflict.
Shortstay acts as an intermediation, management, customer service, documentation, analysis, payment, communication, operational support, and administration platform related to furnished properties for flexible stays, according to the specific conditions of each contract.
1.1. By creating an account, accessing the platform, using the application, requesting support, sending data or documents, making a reservation, signing a contract, making a payment, or using any Shortstay service, the User agrees to be fully bound by these Terms and Conditions of Use, the Privacy Policy, and other instruments applicable to the engagement.
1.2. Acceptance of these Terms is a mandatory condition for using the platform, support channels, and Shortstay services.
1.3. The User declares that they have legal capacity to contract and, when acting on behalf of a legal entity or third party, declares that they have valid authorization to represent them.
1.4. Shortstay may modify these Terms at any time for legal, operational, technological, commercial, security, compliance, fraud prevention, or service improvement purposes.
1.5. The most recent published version will always be the applicable version. Continued use of the platform, application, support channels, or services after the publication of changes shall constitute full acceptance of the updated Terms.
1.6. The User acknowledges that the use of the Shortstay platform depends on compliance with these Terms, the contracts executed, the property rules, condominium regulations, and applicable Brazilian legislation.
1.7. Non-compliance with these Terms may result in suspension of support, restriction of functionalities, account blocking, reservation cancellation, refusal of new engagements, contract termination, collection of amounts due, communication to third parties involved, and adoption of applicable legal measures.
2.1. To use the platform and contract services, the User must provide truthful, complete, current, and verifiable information, including full name, email, telephone, CPF or CNPJ, identification document, nationality, address, profession, proof of income, selfie, and any other documents requested.
2.2. The User is fully responsible for the truthfulness, authenticity, accuracy, and currency of the information and documents provided.
2.3. Shortstay may request additional documents at any time for identity confirmation, fraud prevention, registration analysis, credit analysis, operational security, contractual compliance, condominium requirements, legal obligations, regulatory requirements, or compliance purposes.
2.4. The submission of false, altered, incomplete, inconsistent, third-party documents, or documents incapable of proving the User's identity or financial condition may result in reservation refusal, account suspension, contract termination, collection of damages, and notification to competent authorities.
2.5. The account is personal, individual, non-transferable, and linked to the registered User. It is prohibited to share login credentials, passwords, authentication devices, access codes, documents, or any means of identification with third parties.
2.6. The User is responsible for all activities conducted through their account, including messages, requests, reservations, payments, documents sent, electronic signatures, and property use.
2.7. The creation of false accounts, multiple unauthorized accounts, accounts in the name of third parties, accounts with incomplete data, accounts intended to conceal identity, or accounts used to circumvent rules, fees, suspensions, analyses, restrictions, or Shortstay policies is prohibited.
2.8. Shortstay may monitor, identify, and correlate accounts by indicators such as CPF, CNPJ, email, telephone, IP, device, location, payment method, documents, usage patterns, booking behavior, and other technical or registration elements.
2.9. In the event of evidence of fraud, abuse, attempts to circumvent rules, misuse of the platform, or risk to operations, Shortstay may suspend, restrict, block, or terminate accounts, without prejudice to the collection of amounts owed and the adoption of applicable legal measures.
3.1. The User shall use the platform, application, and support channels exclusively for legitimate, objective purposes directly related to the contracted service, including, without limitation: booking, contract, payment, check-in, check-out, maintenance, cleaning, inspection, documents, invoices, property access, property rules, security, technical support, and other matters directly linked to the stay or contract execution.
3.2. It is expressly prohibited to use the platform, application, WhatsApp, email, telephone, chat, social media, or any other channel made available by Shortstay for personal discussions, private conflicts, family disputes, disputes between guests, relationship problems, individual attacks, improper exposure, harassment, intimidation, threats, embarrassment, harassment, importuning, insults, discrimination, humiliation, accusations lacking any minimum element of proof, or any other purpose unrelated to the object of the contracted service.
3.3. Shortstay does not act as a mediator in personal, family, emotional, commercial, private, or relationship conflicts between Users, guests, third parties, or persons linked to the booking. When the request is demonstrably outside the scope of the contracted service, Shortstay may direct the User to limit their communication to the booking or contract subject matter and, if the situation persists, terminate that specific support interaction, without prejudice to the continuity of the contracted service and the User's rights relating to the booking.
3.4. Shortstay adopts a zero-tolerance policy against harassment, threats, aggression, offensive language, intimidation, discrimination, persecution, psychological abuse, repeated disturbance, verbal violence, or any similar conduct that affects employees, service providers, property owners, guests, condominium administrators, concierge services, management companies, condominiums, or other third parties involved in operations. The measures adopted shall always observe the severity and repetition of the conduct, in respect of the proportionality principle.
3.5. The abusive use of customer service channels shall be considered, among other equivalent conducts:
the repetitive, excessive, or demonstrably unnecessary sending of messages, understood as a volume manifestly disproportionate to what is reasonable for resolving the request;
the opening of multiple tickets on the same subject without the presentation of new facts after a conclusive response has already been provided;
insistence on a request already analyzed, answered in a substantiated manner and definitively closed, without new elements that justify re-analysis;
the attempt to pressure, intimidate, threaten, or constrain the team or third parties, except for the regular and good-faith exercise of rights by the User;
the unjustified refusal to provide data strictly necessary and appropriate for analyzing the request;
the use of offensive, aggressive, discriminatory, or disrespectful language;
the formulation of serious accusations without any minimal element to support them;
the attempt to obtain undue or bad-faith advantage;
the use of customer service for personal disputes or topics demonstrably unrelated to the service.
3.6. Upon identification of abusive, offensive, threatening, disruptive, fraudulent, discriminatory conduct, conduct outside the scope of the service, or conduct incompatible with these Terms, Shortstay may adopt, in a reasoned manner and proportional to the severity and recurrence of the conduct, one or more of the following measures:
request that the User reformulate the request in an objective manner;
formally warn the User;
limit, pause, suspend, or terminate the specific service;
temporarily restrict contact channels, maintaining at least one channel available for essential reservation matters;
block, temporarily or permanently, access to non-essential support channels, maintaining, when there is an active contract or reservation, a minimum channel for essential communications related to the execution of the reservation;
suspend or terminate the User's account, especially for new contracts, without prejudice to the handling of essential obligations related to ongoing contracts;
refuse new reservations;
cancel requests or functionalities incompatible with the verified conduct;
communicate the occurrence to the owner, condominium, management company, concierge, or other legitimately involved third parties, limiting disclosure to strictly necessary information and in compliance with Law No. 13,709/2018 (LGPD);
preserve records and evidence for purposes of defense and compliance with legal obligations;
adopt applicable contractual, civil, criminal, or administrative measures.
3.7. In serious cases — especially threats, harassment, assault, fraud, risk to personal safety, property or condominium disturbance, property damage, material breach of condominium rules or significant violation of these Terms — Shortstay may refer the case for legal review, terminate the contract when applicable, deny new bookings and use available records for the proper defense of its rights and the rights of third parties, in accordance with applicable legislation.
3.8. Account blocking, service suspension, refusal of new reservations, contract termination or access restriction resulting from proven violation of these Terms do not grant the offending User an automatic right to compensation, indemnification, discount, benefit or refund, except for the determination of amounts actually owed in accordance with the contract, applicable legislation and specific reservation rules. The rights guaranteed to consumers by current legislation are likewise reserved, in particular by the Consumer Protection Code, including the right to question, through appropriate channels, any measure deemed improper.
4.1. Shortstay provides services related to intermediation, administration, support, documentation, analysis, payment, communication, inspection, maintenance, cleaning, operational management and other activities linked to furnished properties and flexible stays.
4.2. Shortstay may act as an intermediary between owners, Users, service providers, condominiums, management companies, concierges and third parties necessary for contract execution.
4.3. Contracting, signing, payment, document submission, requests, relevant communications and stay management should preferably occur through Shortstay's official channels, especially through the application when available.
4.4. Shortstay may modify, replace, suspend or discontinue platform features, application or services for technical, operational, commercial, legal, security or compliance reasons.
4.5. The User acknowledges that certain services depend on third parties, including condominiums, security gates, management companies, property owners, banks, payment methods, maintenance providers, internet, electricity, water, gas, and other suppliers, and Shortstay shall not be liable for delays or failures resulting from third-party actions, force majeure, acts of God, or the User's own conduct.
5.1. The User shall comply with these Terms, the applicable rental or accommodation contract, reservation rules, property rules, condominium regulations, security gate guidelines, Brazilian legislation, and other operational instructions from Shortstay.
5.2. The User shall maintain objective, respectful, truthful communication limited to the contracted service.
5.3. The User shall immediately report any issues affecting service execution, property access, maintenance, security, payments, documentation, or property use.
5.4. The User shall preserve the property, furniture, appliances, utensils, linens, equipment, keys, tags, controls, locks, condominium items, and all other provided assets.
5.5. The User shall be responsible for damages, losses, missing items, misuse, omission, negligence, irregular use, condominium violations, fines, repair costs, extra cleaning, item replacement, and any harm caused by themselves, additional guests, visitors, pets, or third parties authorized by them.
5.6. The User may not alter locks, duplicate keys, reset passwords, modify internet settings, restart modems, alter equipment configuration, remove items from the property, move furniture, perform renovations, hire external service providers, or allow third-party access without Shortstay authorization.
5.7. The User shall respect silence, security, cohabitation rules, common areas, garages, elevators, gate houses, schedules, guest limits, and internal condominium regulations.
5.8. The User shall be responsible for any violation committed by additional guests, visitors, invitees, family members, employees, private service providers, or third parties who accessed the property by their authorization.
6.1. To make a reservation, the User shall provide the data and documents requested by Shortstay.
6.2. The reservation shall be subject to registration analysis, document verification, identity verification, property availability, internal approval, contract signature, and payment confirmation.
6.3. Shortstay may refuse a reservation when documents are insufficient, inconsistent, incomplete, invalid, expired, incompatible with the information provided, or when there are indications of risk, fraud, default, abusive behavior, prior non-compliance, or incompatibility with internal policies.
6.4. Shortstay is not obligated to approve reservations, renew contracts, justify internal risk criteria, or accept new requests from Users who have a history of non-compliance, default, abuse, fraud, disturbance, property damage, or violation of these Terms.
6.5. Additional guests shall be previously informed and approved, with submission of required data and documents. Omission of guests, recurring visitors, or unauthorized occupants may result in additional charges, penalties, contract termination, and notification to the condominium.
6.6. The submission of documents through unofficial channels may be refused for reasons of security, authenticity, traceability, and data protection.
7.1. Payment for accommodation, fees, deposit, additional services, renewals, fines, consumables, damages, cleaning, repairs, and other applicable charges shall be made in accordance with the conditions stated in the reservation, contract, application, or invoice.
7.2. Unless otherwise specified in the contract, payments are due in advance and must be settled prior to the release of keys, access codes, entry authorization, renewal, or continuation of accommodation.
7.3. Shortstay may accept payment via Pix, bank slip, credit card, transfer, payment links, or other available payment methods.
7.4. Payment confirmation depends on actual bank clearance or approval by the payment method provider. Receipts, scheduled payments, or payment promises do not replace financial confirmation.
7.5. Invoices paid late shall be subject to, when permitted by applicable law and without prejudice to specific contract rules:
a) default penalty of up to 10% on the overdue amount, when applicable to consumer relations;
b) late payment interest of 1% per month, calculated pro rata die, when contractually provided;
c) monetary adjustment by the IPCA or other index provided for in the contract or applicable legislation;
d) collection of administrative, banking, notarial, judicial, extrajudicial expenses and attorney's fees, when collection becomes necessary;
e) suspension of services, restriction of functionalities, blocking of new reservations and adoption of applicable legal measures.
7.6. When there is no agreed interest rate or when legislation determines otherwise, legal interest and monetary adjustment may be applied in accordance with the Civil Code and applicable legislation.
7.7. Payment delay may prevent check-in, renewal, access release, contract continuity, issuance of entry authorization, request for additional services, or approval of new reservations.
7.8. Non-payment does not prevent the collection of due and future amounts, contractual penalties, property damage, consumption, cleaning, replacement of items, fees, collection expenses and other amounts provided for in the contract or determined at the end of the stay.
7.9. Shortstay may use deposits, credits, retained amounts, pending refunds or any sums owed to the User to offset outstanding amounts, damages, penalties, consumption, cleaning, replacements, overdue invoices, fees and other contractual obligations.
7.10. Disputing a payment, chargeback, unwarranted dispute, unjustified cancellation, payment fraud, or attempted reversal of regularly owed amounts may result in account suspension, full collection, notification to the payment method, credit reporting where applicable, and adoption of legal measures.
7.11. Amounts paid as entry fees, analysis, processing, reservation, contracting, services rendered, blocked dates, administrative expenses, or other amounts expressly stated as non-refundable shall not be refunded, except in case of legal obligation or specific contractual provision.
8.1. Shortstay may require a security deposit or security deposit, the amount of which shall depend on the property, term, cadastral analysis, documentation presented, operational risk, and reservation conditions.
8.2. The security deposit may be used to offset amounts owed by the User, including damages, loss of items, checkout cleaning, consumption, condominium fines, outstanding invoices, repairs, replacements, keys, tags, controls, irregular use, additional services, and other debts.
8.3. The return of the security deposit, when applicable, shall occur after checkout, exit inspection, consumption verification, damage assessment, review of outstanding matters, and offset of amounts owed.
8.4. The existence of a security deposit does not limit the User's liability. Should damages exceed the deposited amount, the User shall remain responsible for payment of the difference.
9.1. Cancellations, date changes, early departure, no-show, and renewals shall be subject to the rules provided at the time of booking, in the contract, and in the applicable policy.
9.2. Date blocking, document analysis, contract preparation, property availability, operational costs, and refusal of other bookings may justify retention of non-refundable amounts, in accordance with the stated rule and applicable legislation.
9.3. Early departure at the User's discretion does not generate an automatic right to refund of amounts paid, security deposit, rent, fees, or services, without prejudice to the final settlement of amounts due and specific contract rules.
9.4. Renewal requests are not guaranteed and depend on property availability, owner approval when applicable, absence of outstanding issues, internal review, execution of a new instrument, and advance payment.
9.5. Shortstay may refuse renewal in case of non-payment, breach of contract, condominium complaints, misuse of the property, abusive conduct, operational risk, property necessity, owner decision, or any violation of these Terms.
10.1. Check-in shall occur in accordance with the time, rules, and instructions provided in the booking, contract, or application.
10.2. Access to the property shall only be granted after booking approval, contract execution, submission and validation of required documents, payment confirmation, and compliance with other applicable conditions.
10.3. Shortstay may share with the condominium, management company, condominium administrator, physical or remote security desk the minimum data necessary for authorization of entry, security, identification of guests, and compliance with building rules.
10.4. The User is responsible for following access instructions, key retrieval, use of electronic locks, tags, controls, security desk, garage, and common areas.
10.5. Misuse of keys, tags, controls, passwords, QR codes, authorizations, or entry documents may result in replacement charges, access blocking, notification to the condominium, and applicable legal measures.
11.1. The property shall be used exclusively for the contracted purpose, respecting the term, occupancy limit, condominium rules, safety standards, quiet enjoyment, maintenance, and residential or permitted use.
11.2. It is prohibited to use the property for parties, events, unauthorized commercial activities, subletting, hosting of undeclared third parties, illicit activities, storage of hazardous materials, disturbance of quiet enjoyment, unauthorized commercial filming, or any use incompatible with the contract.
11.3. The User shall respect the maximum number of guests stated in the reservation and authorized by Shortstay.
11.4. Visitors shall only be permitted when authorized by the property rules, condominium, and Shortstay. The User shall consult with Shortstay in advance before receiving visitors, especially in buildings with access control.
11.5. Non-compliance with occupancy rules, visitors, noise, garage, condominium, animals, security, or maintenance may result in fines, damage charges, notification to the condominium, contract termination, and refusal of future bookings.
11.6. Shortstay may adopt applicable contractual and legal measures in case of irregular occupancy, unjustified resistance to vacating, serious non-compliance, security risk, non-payment, or violation of property rules.
12.1. The User, additional guests, visitors, and authorized third parties must fully comply with condominium rules, including noise restrictions, use of common areas, garage, elevators, swimming pool, gym, party room, waste disposal, security, registration at the gate, and internal circulation.
12.2. Fines applied by the condominium, management company, condominium manager, or competent authority due to conduct of the User, guests, visitors, pets, or authorized third parties shall be entirely charged to the User.
12.3. The lack of prior specific knowledge of a particular condominium rule does not exempt the User from the duty to comply with it, when the rule is available, communicated by the condominium, derives from standard rules of coexistence, or results from applicable legislation.
12.4. Condominium complaints, internal bulletins, gate records, images of common areas, communications from the condominium manager, management company, or neighbors may be used as evidence for investigating infractions.
13.1. Pets shall only be permitted in properties and condominiums that accept them, subject to prior notification, approval by Shortstay, and payment of applicable fees.
13.2. The User shall provide information regarding the species, size, quantity, and other requested data about the animal.
13.3. The presence of an undisclosed animal, an animal in a property that does not permit pets, or non-compliance with condominium rules related to animals may result in fines, additional charges, specialized cleaning, contract termination, and refusal of future reservations.
13.4. The User shall be responsible for damages, odors, stains, noise, dirt, cleaning, pest control, extra cleaning, replacement of items, damage to furniture, mattresses, sofas, curtains, carpets, linens, flooring, and any other losses caused by the animal.
14.1. Requests for maintenance, cleaning, or inspection shall be made through Shortstay's official channels, preferably via the application.
14.2. The User shall provide a clear description of the issue, photos, videos, and information necessary for analysis and service execution.
14.3. Shortstay may schedule access to the property for maintenance, cleaning, inspection, repairs, inspections, item replacement, damage assessment, legal compliance, security, or asset preservation.
14.4. When necessary, service providers may access the property by appointment, authorization, supervision, or operational procedure defined by Shortstay.
14.5. For security, transparency, and dispute prevention, Shortstay may use photographic records, videos, reports, checklists, geolocation, logs, body cameras, and other evidence related to service execution, always in compliance with applicable legislation.
14.6. The User may not unjustifiably prevent essential maintenance, necessary inspection, urgent repair, or previously communicated access, especially when there is risk to the property, condominium, security, equipment operation, or third-party rights.
14.7. Unjustified refusal of access, failure to disclose a problem, delay in communication, or attempt to conceal damage may increase the User's liability for resulting losses.
15.1. Shortstay will process personal data in accordance with its Privacy Policy, the General Law for the Protection of Personal Data, the Internet Civil Rights Framework, and other applicable regulations.
15.2. The User authorizes the processing of data necessary for registration, authentication, document analysis, fraud prevention, contract execution, customer service, payments, entry authorization, communication with the condominium, stay management, security, legal compliance, regular exercise of rights, and protection of operations.
15.3. Shortstay may collect and store access records, logs, IP addresses, device information, location, messages, documents, receipts, protocols, service reports, electronic evidence, images, videos, electronic signatures, and audit records necessary for service execution, platform security, fraud prevention, and defense of rights.
15.4. Minimum necessary data may be shared with owners, condominiums, management companies, building administrators, concierge services, service providers, payment processors, technology suppliers, accounting firms, legal advisors, public authorities, or third parties strictly necessary for contract execution or legal compliance.
15.5. Shortstay may retain records, messages, documents, and evidence for the time necessary to comply with legal, regulatory, and contractual obligations, exercise regular rights, prevent fraud, defend in administrative, judicial, or extrajudicial proceedings, and protect operational security.
15.6. The User acknowledges that messages sent to Shortstay's official channels may be recorded, monitored, analyzed, and used for quality control, security, compliance, proof of request, defense of rights, and investigation of violations of these Terms.
15.7. The User shall not send personal data of third parties without authorization or legitimate necessity. When providing information about additional guests, visitors, or third parties, the User declares that they have authorization to provide such information.
16.1. Contracts, amendments, authorizations, inspections, acceptance of terms, confirmations, communications, and other documents may be signed or accepted electronically.
16.2. The User acknowledges the legal validity of electronic signatures, digital acceptances, audit records, access logs, geolocation, timestamps, submitted documents, messages, and other electronic means used by Shortstay.
16.3. Electronic signature or digital acceptance performed through the User's account shall be presumed valid, except in the event of unequivocal proof of fraud not caused by fault, negligence, sharing of access, or conduct of the User themselves.
16.4. The User is responsible for maintaining their devices, email, telephone, password, authentication, and access methods secure and up to date.
17.1. The platform, application, brand, name, logo, texts, images, videos, flows, systems, layouts, database, functionalities, processes, documents, reports, technologies, integrations, and other elements of Shortstay are protected by intellectual property rights.
17.2. The User receives only a limited, revocable, non-exclusive, non-transferable, and temporary license to use the platform in accordance with these Terms.
17.3. It is prohibited to copy, reproduce, modify, resell, exploit, improperly access, attempt reverse engineering, scrape data, automate access, interfere with systems, violate security, use bots, or use the platform for unauthorized purposes.
17.4. Improper use of Shortstay's brand, visual identity, content, data, systems, or documents may result in account suspension, recovery of damages and losses, and applicable legal measures.
18.1. The User shall be liable for all material, moral, direct, indirect, operational, contractual, condominium, administrative, judicial or extrajudicial damages caused to Shortstay, property owners, properties, condominiums, employees, service providers, guests, third parties or other parties involved.
18.2. The User's liability includes, without limitation, damages to the property, furniture, appliances, utensils, linens, locks, keys, tags, controls, garage, common areas, equipment, internet, documents, reputation, operations, customer service, security and contracts.
18.3. The User shall also be liable for damages resulting from fraud, bad faith, omission of information, false documents, improper chargeback, non-payment, refusal to vacate, disturbance, harassment, threats, insults, improper exposure, false reports, breach of contract or abusive use of the platform.
18.4. Shortstay may use all means of proof permitted by law, including electronic records, messages, documents, logs, photos, videos, inspections, reports, condominium communications, protocols, location, payment records and other available evidence.
18.5. No provision of these Terms limits Shortstay's right to seek compensation, enforcement of obligations, collection, urgent relief, communication to authorities or any measure necessary to preserve its rights.
19.1. Shortstay may suspend, restrict, block or terminate the User's account, in whole or in part, in case of violation of these Terms, contract, reservation rules, property rules, condominium regulations, applicable legislation or internal security policies.
19.2. The following may also justify suspension, blocking, cancellation, or termination:
a) non-payment;
b) fraud or suspected fraud;
c) false or inconsistent documents;
d) false account or use of a third party's account;
e) abusive behavior in customer service;
f) harassment, threats, offense, discrimination, or disturbance;
g) misuse of the property;
h) damage to assets;
i) condominium violations;
j) undeclared guests;
k) unauthorized subletting or assignment;
l) use of the property for prohibited purposes;
m) chargeback or undue dispute;
n) risk to safety, operations, or third parties.
19.3. In case of serious breach, Shortstay may terminate the contract, cancel future reservations, refuse new bookings, block communication channels, and adopt applicable legal and contractual measures.
19.4. Termination, blocking, or suspension due to User fault does not exempt the User from payment of amounts due, amounts to become due, penalties, damages, consumption, services, collection expenses, fees, and other applicable obligations.
19.5. When involving an occupied property, Shortstay shall adopt applicable contractual and legal measures, including notifications, collections, communication to the owner, condominium, legal counsel, and competent authorities, when necessary.
20.1. Shortstay's official communications may occur via application, email, WhatsApp, telephone, SMS, push notification, chat, platform, contract, or any means informed by the User.
20.2. The User shall keep their contact information updated. Shortstay is not responsible for communication failures resulting from incorrect, outdated, inaccessible, or blocked contact data by the User.
20.3. Messages sent to registered contacts shall be considered valid for purposes of operational communication, collection, notification, renewal, cancellation, termination, warning, document request, maintenance, inspection, and other matters related to the contract.
20.4. Shortstay may require that certain requests be made exclusively through the application or specific official channel to ensure security, traceability, and data protection.
21.1. Shortstay shall not be responsible for facts arising from the exclusive fault of the User, guests, visitors, third parties, condominium, management company, concierge, owner, unauthorized external service providers, public utility concessionaires, financial institutions, payment methods, act of God, or force majeure.
21.2. Shortstay does not guarantee uninterrupted availability of internet, electricity, water, gas, elevators, common areas, condominium services, third-party systems, applications, banks, or payment methods.
21.3. Shortstay is not responsible for personal items, valuables, documents, equipment, luggage, vehicles, packages, or belongings left in the property, common areas, garage, or reception.
21.4. The User shall exercise reasonable care, vigilance, and security measures regarding children, elderly persons, animals, personal items, use of equipment, windows, balconies, appliances, swimming pool, garage, common areas, and other environments.
21.5. No clause in these Terms is intended to exclude liability that cannot be excluded by law. Any limitations shall be applied to the maximum extent permitted by Brazilian legislation.
22.1. These Terms shall be governed by Brazilian legislation, including, as applicable, the Civil Code, the Tenancy Law, the Consumer Protection Code, the General Data Protection Law, the Internet Civil Rights Framework, legislation on electronic signatures, condominium regulations, and other applicable laws.
22.2. The User acknowledges that violation of these Terms may result in contractual, civil, administrative, and, where applicable, criminal liability.
22.3. The abusive exercise of rights, bad faith, fraud, threats, harassment, disturbance, non-payment, breach of contract, document falsification, false declaration, or attempt to obtain undue advantage may justify the collection of damages and other applicable measures.
23.1. Any tolerance by Shortstay regarding non-compliance with any obligation shall not constitute waiver, forgiveness, novation, or alteration of these Terms.
23.2. Should any clause be deemed invalid, null, or unenforceable, the remaining clauses shall remain fully valid and effective.
23.3. These Terms, together with the Privacy Policy, reservation contract, property rules, condominium regulations, and related documents, constitute the entire agreement applicable to the relationship between the User and Shortstay.
23.4. Shortstay may assign, transfer, or reorganize rights and obligations related to the platform or operation, in compliance with applicable legislation.
23.5. Clauses that, by their nature, must survive the termination of the relationship shall remain in effect, including payment, liability, indemnification, privacy, records, intellectual property, collection, and jurisdiction.
24.1. For the resolution of disputes arising from these Terms, the Court of the District of Curitiba, State of Paraná, is hereby elected, except when applicable legislation determines a different mandatory court.
24.2. Prior to the adoption of judicial measures, Shortstay may seek administrative resolution, extrajudicial collection, notification, amicable settlement, or mediation, without this constituting a waiver of any rights.
